The wrongful death lawsuit was filed in Caldwell County Missouri by Nick and Justin's mother, Lisa Diemel, and Diemel's Livestock. The defendants are Garland Nelson who is accused of murdering the brothers, Tomme Sue Feil who is Nelson's mother, and J4S Farm Enterprises which is their business. The case ended in a $2 million settlement.
Tomme Sue Feil is a part of the lawsuit because she's the one who started J4S Farm Enterprises and allowed Nelson to work there even after he was released from prison for cattle fraud. The lawsuit stated that Feil didn't watch her son as good as she should've and that was also one of the reasons the brothers were murdered.
Nick and Justin Diemel went to Missouri last July to receive a payment of $250,000 from Nelson. The brother's remains were later found on Nelson's farm in Missouri and in Nebraska. Earlier this month Nelson entered a not guilty plea after being charged with two counts of first-degree murder. The state of Missouri is seeking the death penalty.
